Appeals in the areas of Estates and Trusts include things like challenging a will, and resolving various issues with incapacity.  Our practice has taken us to the appellate courts on various issues that arise out of will contests.  Contesting a will is an extremely personal decision and often is a product of family discontent.  Estate litigation can pit family members against each other or families against other families.  Wills can be contested on various grounds including testamentary capacity, undue influence, and fraud.  Various errors on summary judgment, trial testimony, admission of evidence can arise during the litigation.
